Bill Chapman and Steve Banks obtained summary judgment in New Haven Superior Court for the landlord of a shopping center. The employee of a tenant sued after he slipped and fell on ice in the parking lot. The plaintiff sustained a serious head injury and claimed $100,000 in special damages. The defense argued that the landlord owed no duty of care under Connecticut law because, under the terms of the applicable ground lease, the landlord did not retain possession or control of the property.
