Another Defense Verdict!

After a weeklong trial, Bill Chapman and Diana Pires obtained a defense verdict for our grocery store client from a jury in Dedham District Court. The plaintiff slipped and fell in a puddle of water at the grocery store. She claimed severe and permanent back injuries and alleged that the grocery store was liable under a mode of operation theory. She also argued that the grocery store spoliated video evidence of her accident. Bill argued there was no liability under a mode of operation theory or otherwise. The trial judge repeatedly sustained his objections to the spoliation claims. Bill methodically refuted the plaintiff's damages case by introducing her extensive medical history. The defense was so compelling that the jury only deliberated for approximately 15 minutes. Diane prepared the case in discovery, and her thorough deposition work enabled targeted cross examinations at trial.
