Michael Mazurczak and Brian Lipkin delivered a presentation on mediation titled "Closing The Deal" at the monthly meeting of the Boston Area Claims Executives (BACE). Since statistically most civil cases settle, setting expectations is critical. Selection of the appropriate mediator and thorough preparation is essential to success. Mediation offers an opportunity for the client to decide the case. In nearly 60% of cases that do not settle, plaintiffs ultimately receive a judgment less than the offer of settlement. In 24% of cases, defendants are held responsible for significantly more than the pretrial demand. Maz and Brian shared their thoughts and experiences with the BACE insurance professionals on how to best achieve mediation success.
