On March 31, 2017, Bill Keville spoke at Claims Litigation Management’s 10th Anniversary Annual Conference in Nashville, TN. The CLM is the largest professional association in the insurance industry with a membership of more than 35,000 professionals in the claims resolution and litigation management industries. The annual conference is the organization’s largest industry event. The 2017 conference began on the stage at the Grand Ole Opry, attracted 2,000 participants and featured nearly 100 interactive educational opportunities.
Bill was part of a panel presentation entitled, “The Duty to Initiate Settlement Discussions without a Demand by the Claimant.” Key takeaways from the discussion included:
1. The duty to initiate settlement is a hot issue and has generated significant recent debate.
2. Even if your state has the duty to initiate settlement discussions, an insurer who develops processes and trains on them will be ahead of the game.
3. Officially, the Restatement of the Principles of the Law of Liability Insurance is likely to take a neutral position on the subject in the much anticipated revision to Section 24 which is due to come out in May.
